Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Zachary Cleversley, doing business as GloomDeep (“GloomDeep,” “we,” “us,” or “our”), and govern your use of the GloomDeep mobile game and related services (the “Game”). By downloading or playing GloomDeep, you agree to these Terms. If you do not agree, do not use the Game.
1. Eligibility
You must be at least 13 years old to play. If you are under the age of majority where you live, you may only use the Game with the consent of a parent or legal guardian who agrees to these Terms.
2. License
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and play GloomDeep for your own personal, non-commercial entertainment, subject to these Terms.
3. Ownership and intellectual property
The Game and everything in it — including its code, artwork, characters, music, sound, text, names, logos, game design, and other content (the “Content”) — is owned by us or our licensors and is protected by copyright, trademark, and other laws. The license in Section 2 lets you play the Game; it does not give you any ownership of the Content.
Except where the law allows it or we give written permission, you may not copy, reproduce, distribute, sell, publicly display, modify, or create derivative works from the Content, and you may not extract or reuse our assets. Some third-party assets in the Game are used under their own licenses, which remain with their respective owners.
4. Your account
You are responsible for activity that happens under your account and for keeping your sign-in secure. Do not share your account or impersonate others. We may suspend or terminate accounts that violate these Terms.
5. Acceptable use
You agree not to:
- cheat, use bots or automation, or exploit bugs to gain an unfair advantage;
- reverse engineer, modify, or tamper with the Game or its servers;
- disrupt, overload, or attempt to gain unauthorized access to the service;
- harass, threaten, or abuse other players; or
- use the Game for any unlawful purpose.
6. Virtual items and currency
The Game includes virtual goods, including in-game gold and premium credits. These have no monetary value, cannot be exchanged for real money, and are licensed to you — not owned by you. They are non-transferable and non-refundable except where required by law. We may modify, manage, or remove virtual items and adjust game balance at any time. In-app purchases are sold through the Apple App Store and are subject to Apple’s terms; refund requests are handled by Apple.
7. User content and social features
The Game includes social features such as friends, guilds, co-op parties, direct messages, and world and guild chat. You are responsible for the content you submit, and you agree not to post content that is unlawful, harassing, hateful, threatening, sexually explicit, or that infringes someone else’s rights.
You keep ownership of the content you submit, but you grant us a worldwide, royalty-free license to store, transmit, display, and moderate it as needed to operate the Game. We use automated and manual moderation and may remove content, and suspend or terminate accounts, that violate these Terms. You can report abuse and block other players using the in-game tools.
8. Service changes and availability
The Game is under active development and is provided on an “as is” and “as available” basis. We may change, suspend, or discontinue any part of the Game, and during development we may reset or wipe test data and progress. We do not guarantee uninterrupted or error-free service.
9. Disclaimers and limitation of liability
To the fullest extent permitted by law, the Game is provided without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Game, and our total liability is limited to the amount you paid us, if any, in the twelve months before the claim.
10. Termination
You may stop using the Game at any time. We may suspend or terminate your access if you violate these Terms or to protect the Game and its players.
11. Apple App Store
This Section 11 applies when you download or use the Game on an Apple device through the App Store, and supplements Apple’s standard Licensed Application End User License Agreement (EULA) and the Apple Media Services Terms, which also apply. If there is any conflict between this Section 11 and the rest of these Terms with respect to your App Store use of the Game, this Section 11 controls.
- Acknowledgement. These Terms are between you and us only, and not with Apple. We, not Apple, are solely responsible for the Game and its content.
- Scope of license. The license granted to you in Section 2 is non-transferable and limited to use of the Game on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms, except that the Game may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
- Maintenance and support. We are solely responsible for providing any maintenance and support services for the Game. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the Game.
- Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the Game fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of the Game to you; to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Game.
- Product claims. We, not Apple, are responsible for addressing any claims by you or any third party relating to the Game or your possession and use of it, including product liability claims, any claim that the Game fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.
- Intellectual property rights. In the event of any third-party claim that the Game or your possession and use of it infringes that third party’s intellectual property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
- Legal compliance. You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Third-party terms. You must comply with any applicable third-party terms of agreement when using the Game.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
- Contact. If you have any questions, complaints, or claims regarding the Game, please contact us at the name and address set out in Section 14.
12. Governing law
These Terms are governed by the laws of the State of New York, United States of America, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in New York will have exclusive jurisdiction over any dispute arising from these Terms, except where applicable law gives you the right to bring a claim elsewhere.
13. Changes to these Terms
We may update these Terms from time to time. We will revise the “Last updated” date above, and significant changes will be announced in the Game. Continued play after changes means you accept the updated Terms.
